5.9 Boundary changes—general—application and implementation

5.9.1 In general

Any boundary changes made by any Boundary Commission have the same effect as if they had been adopted by the Parliament with Bills by that Act.

5.9.2 The changes adopted are as follows:

(a) unless otherwise provided in section 5.10 of this Act, the boundary lines for new constituencies (as defined in section 5.7 of this Act) shall extend from,

(i) the boundary line dividing the largest area of the current parliamentary constituency for which constituency boundaries are being drawn, to a line, or, in the case of constituencies with a defined electoral district, from,

(ii) a line extending in the direction of the boundary line dividing the largest area of the constituency of a party for which constituencies may not be drawn at the same time, to that boundary line.

In order to be relevant to a boundary change, a boundary is to be defined on the basis of a local constituency area.

(b) and (c) are not applicable to boundary changes that do not involve the drawing of constituencies at the same time as they would otherwise require the drawing of constituencies.

5.9.3 The Boundary Commission may adopt rules requiring:

(a) the boundary commission to provide the parties with sufficient information to enable them to comply with their obligations under the Boundary Commission Act, this Order and its application or implementation; and

(b) the parties to comply with their obligations and the Boundary Commission to publish notice of those obligations.

Gavin Smith, a former fireman who now is an engineer at the New England Climate Services, a community shelter, has watched the situation play out across New England.

"I don't think people are seeing it," said Smith. "We are looking at people who are looking for work and some who are in temporary or long-term shelter because there's no place to stay."

While temporary shelters are in high demand, Smith said the reality for many people is that a steady job isn't enough to keep them in a city.

While New Jersey is a leader in "greening" the state by removing invasive plants, that doesn't come close to addressing the issue, said Smith.

"So many New Yorkers don't understand how green it is in New York and they think it's the same or worse," said Smith. "It's not."

Smith said there's one other area where Greenpoint and Queens, home to the borough of Manhattan, differ from other places in the city. Greenpoint is very green, he said. And there are no trash-related complaints from people living there.

"But Queens, people here in Queens, they have to pay to recycle," he said. "They have to get rid of recyclables. They put up a fence and stuff. Some of those things are worse than New Jersey does in terms of what they waste. You have to know what you're doing and know if you're saving the environment."

Smith worries that people might be putting in too much effort to try to stay in the area without knowing the rules.

"My fear," he said, "is it's going to go worse and worse."
